NY State Budget Cuts City Public Health Funding by $59M

The state's $175.5 billion budget includes a $59 million cut to public health funding for the city Health Department, Mayor Bill de Blasio said on Monday. The budget lowered the state's reimbursement for health services provided by the city to a minimum of 20%, compared with 36% for all other municipalities statewide. De Blasio said the funding is used for newborn home visits; clinics that treat STDs, HIV and tuberculosis; and public health response services that have been used for Legionnaires' disease, West Nile and Zika. It is also used to combat opioid addiction and test updated vaccines for diseases such as measles and...

Proposal Would Allow Pothole Damage Claims Year-round

Some New York lawmakers are pushing a bill that would require the state to reimburse drivers for pothole-related repairs all year-round. Currently in New York, who is responsible for car damage from potholes depends on the time of the year. If it’s between November and May, when most potholes form, you cannot file a claim. Some state legislators are proposing a bill that would change that. One version of the legislation would create a reporting system that gives the state 14 days to fix the pothole – otherwise it would have to start paying claims. AAA New York says something needs to change...

App Alerts Consumers to Dangerous Products

The United States Consumer Product Safety Commission (CPSC) has created a recall app that alerts people when a product has been declared defective and recalled. The country’s chief product safety regulator created the app to make recall information more accessible to consumers and. The app is just one part of the CPSC’s efforts to make the recall communication process more modern, and the CPSC is hoping to encourage manufacturers to develop marketing strategies for recalls so consumers will know right away that a product they’ve bought or used is unsafe. With this app, the CPSC is hoping that consumers will be more likely to...

Trial Win in Wrongful Death Case Against Distracted Driver

Distracted drivers caused 54,302 crashes, injuries, and wrongful deaths in North Carolina in 2016.  If you travel on the streets or highways, you are at risk for being injured or killed by someone who is more interested in their phone than their driving. On the morning of May 10, 2016, Russell Rutledge was driving his Chevrolet Silverado from a business meeting in Garner to meet a colleague in Durham. As he drove, Rutledge was using his cell phone to text, email, and make and receive phone calls.  The evidence showed that Rutledge drifted onto the shoulder of Highway 98 in Durham...

NYPD Suspends Body Camera Requirement After 1 Explodes

The New York City Police Department scrambled Monday to find ways to quickly replace thousands of body camera devices it suddenly stopped using after an officer said one caught fire and exploded as he headed out on patrol over the weekend. The department shelved about 3,000 of its newest model Vievu LE-5 units, about one-fifth of its body camera inventory. Officers using other models will continue to wear them, the department said. Deputy Commissioner Jessica Tisch said pulling the LE-5 cameras from use made it unlikely the department would meet its goal of equipping the vast majority of officers with body cameras by the...

OSHA Reveals Top 10 Violations for 2018

The Occupational Safety and Health Administration (OSHA) announced the preliminary Top 10 most frequently cited workplace safety violations (current as of October 1) for fiscal year 2018. Patrick Kapust, deputy director of OSHA’s Directorate of Enforcement Programs, presented the Top 10 as part of the 2018 NSC Congress & Expo, an annual gathering of safety professionals. The Top 10 for Fiscal Year 2018 are: 1. Fall Protection – General...

N.Y. Limo Service Operator Charged in Crash That Killed 20

A limousine service operator was charged Wednesday with criminally negligent homicide in a crash that killed 20 people, while police continued investigating what caused the wreck and whether anyone else will face charges. Nauman Hussain, 28, showed little emotion as he was arraigned Wednesday evening in an Albany-area court, and he ignored shouted questions from reporters as he left after posting $150,000 bond. A judge had entered a not guilty plea for him. Earlier, his lawyer said that Hussain wasn’t guilty and that police were rushing to judgment in investigating Saturday’s stretch limo wreck . But State Police Superintendent George Beach said Hussain hired...

NJ Transit Will Miss Deadline for Installing Positive Train Control

Lifesaving technology aboard New Jersey Transit trains won’t be in place by a Dec. 31 deadline set by Congress, the agency’s executive director told board members. The operator of the nation’s second-biggest commuter railroad, which leads its peers for accidents and federal safety fines, instead will shoot for a two-year extension for the project known as positive train control from the Federal Railroad Administration, according to a memo to the board by Executive Director Kevin Corbett. “We expect to meet the FRA’s statutory requirements by the end of 2018 and receive federal approval to have PTC fully implemented on our rail system by Dec. 31, 2020,”...

Law Firm Can’t Toss Woman’s $25M Fraud Suit

A Manhattan federal judge refused Friday to toss a $25 million fraud suit targeting Weitz & Luxenberg brought by a woman who says the plaintiffs firm took on her 20-year-old breast implant injury case against Bristol-Myers Squibb but allowed it to be dismissed without telling her. U.S. District Judge Alvin K. Hellerstein set up a briefing schedule that would allow counsel for Beverly J. Ezra to amend her claims against the law firm, the $99 billion pharmaceutical giant and its Medical Engineering Corp. subsidiary, already named as defendants in a related case. The judge indicated he was inclined to let Bristol-Myers out of the case after...
