When can you sue the government (and when can you not)? The doctrine of sovereign immunity varies from state-to-state, but could impact your personal injury lawsuit. The term “sovereign immunity” sounds like something that might be uttered during a conversation between a high-ranking government official and a foreign leader. But in reality, sovereign immunity is a legal doctrine that could impact your personal injury claim. Let’s take a closer look at sovereign immunity and how it may impact your lawsuit. What is sovereign immunity? Sovereign immunity is a legal doctrine that prevents a state government from being sued without its consent.Sovereign immunity might prohibit you from suing...

Will the Person Who Caused My Injury Get Punished?

No. Punishment comes from criminal cases, not civil cases. Defendants in civil actions for personal injury do not receive jail terms or stiff fines as punishment. Those are criminal sentences and personal injury cases are civil disputes. (But juries and courts can award what the law calls punitive damages when the defendant's intentional acts have injured you. These awards are rather rare.) [American Bar] ...

Do I Have a Personal Injury Case?

If you’ve suffered significant harm because of someone else’s obvious carelessness ("negligence" in legalese), this may not be a tough question to answer. But many situations are not so cut-and-dried. If you’re figuring out whether you have a valid personal injury claim—one that would justify going to the time and trouble of filing an insurance claim over the incident or bringing a lawsuit to civil court—there are a few key factors that can help you decide. How Serious Are Your Injuries? Any time you think someone else did something that resulted in harm to you, or simply did something that put you in...

What is the Personal Injury Statute of Limitations in New York?

Whether your potential legal claim stems from a slip and fall, a traffic accident, or any other incident where someone else's conduct caused you harm, you might be thinking about filing a personal injury lawsuit in New York's civil courts. If so, it's crucial that you comply with the statute of limitations for this type of case. (A little background for those who may not be fluent in "legalese": a statute of limitations is a law that puts a time limit on your right to file a lawsuit in court.) In this article, we'll cover the details of New York's personal injury statute of limitations,...

Travelers Get Green Light From Court to Sue Airport Screeners

A U.S. appeals court has rejected the notion that federal airport screeners are immune from lawsuits filed by aggrieved travelers. In a 9-4 decision, the Court of Appeals in Philadelphia ruled that Transportation Security Officers, given their authority to conduct invasive searches of travelers, are essentially law enforcement officers and as such aren’t covered by the immunity granted to most federal agencies and employees. The ruling overturns a lower court judge’s dismissal of a lawsuit brought by Nadine Pellegrino of Florida who claimed her belongings were damaged during a search at Philadelphia International Airport and she was falsely arrested. Writing for the majority,...

What Does the Future Hold for NYC’s Vision Zero Plan?

On Tuesday, July 9, more than 1,000 cyclists laid on the ground of Washington Square Park during a “die-in” to protest the dangerous conditions of riding a bicycle on New York City streets. Among the prone protestors, a smattering stood with signs reading names of the 15 cyclists killed in the first seven months of the year. The crowd was mostly quiet, except for a trumpet player and chant of each name. In the weeks since the die-in, there have been more, albeit smaller, vigils. One for Alex Cordero, a 17-year-old bicyclist struck and killed by a tow truck on Staten Island. Just a few...

How Data & Analytics Are Helping Insurers With Flood-Damaged Vehicles

Initial estimates of the damage caused by Hurricane Florence are expected to total approximately $20 billion, as residents of the Carolinas and Virginia are faced with cleanup and recovery. The Carolinas experienced historic flood levels, according to Moody’s Analytics. Mark Zandi, chief economist for the firm, said the flooding was more extensive than anticipated because it was such a slow-moving system. The analyst firm also said Florence will end up being one of the ten costliest hurricanes America has ever seen. While homes and businesses face their own cleanup from the flooding, personal transportation causes great headaches as well. Early estimates from...

Brake inspection spree for CMV drivers set for September

On behalf of Orin Cohen of Orin J. Cohen Law From September 16 to 22, commercial motor vehicles across New York and the rest of the U.S. will be subjected to a brake inspection spree. The Commercial Vehicle Safety Alliance conducts this inspection spree, called Brake Safety Week, once a year as a way to ensure that truckers routinely check their brakes and maintain them according to the manufacturer's guidelines. Good brakes mean more efficient braking, which can prevent rear-end collisions and other accidents. In its effort to keep the public safe on the roads, the CVSA will be conducting mostly Level I inspections, which are...
